Alternative Dispute Resolution in Civil Disputes

In order to understand this concept effectively, we need to establish what Alternative Dispute Resolution means in relation to and its involvement in civil disputes. Because of the fact that of the main disadvantages legal system is access to justice, Alternative Dispute Resolution (known as ADR) was created in order to provide an alternative method to the official court procedures in resolving disputes.

The main characteristic of ADR is to accomplish an agreement between the disputing parties involved without the use of the traditional court process.

“Alternative Dispute Resolution, offers parties an alternative means of resolving their differences outside actual courtroom litigation…”

The prohibitive cost of litigation for the average person and those are unable to afford representation, means they often loose out in disputes; the use of Mediation services offers everyone a means to have the access to justice.

Over recent years, ADR has been gained considerable momentum as a means to resolve Civil disputes, either as a pre or post action process to resolve disputes.
