Letters of Administration

If a person dies without a will, a family member would need to apply for Letters of Administration before the deceased's assets can be distributed. The formula that dictates who receives what, and may bear little or no resemblance to your true wishes.

If there is no willing family member able to act as beneficiary, the court may appoint a trustee, who may act for a fee. This process takes time, stress and expense.

“At GJC Law, we will guide you through the process from start to finish”

According to the Intestate Succession Act, the priority of distribution is as follows:
  1. Spouse, children
  2. Parents
  3. Siblings
  4. Grandparents
  5. Aunts and Uncles.
